Parkland Cares’ Terms, Conditions and Privacy Policy and its practices are modeled on transparency, accountability and choice regarding the collection and use of your personal information. This disclosure covers the website www.parklandcares.org and our mobile applications.

Welcome to the private website for Parkland Cares, a nonprofit organization created and led by several Parkland community members whose friends and loved ones were impacted by the tragic shooting at Marjory Stoneman Douglas High School in Parkland, FL on February 14, 2018. Parkland Cares mission is: Provide immediate and long-term funding and awareness for mental health counseling for the Marjory Stoneman Douglas shooting survivors, their families, and the community-at-large.

This website and our mobile applications refer to the two organizations collectively under our name, Parkland Cares.

Users of this website and our mobile applications, including guests and donors, are subject to the provisions of these Terms, Conditions and Privacy Policy (“Terms”). By using this website and our mobile applications or viewing the content herein you accept and agree to be bound by the Terms and each of its provisions. This is a legally binding agreement between you and Parkland Cares, so please read it carefully. If you do not agree to the Terms, do not use this website and our mobile applications. Eligibility

All users of this website and our mobile applications must be 14 years of age or older. If you do not so qualify, do not attempt to use this website and our mobile applications. Your User account and any User-Generated Content (as defined below) may be deleted without warning if we believe that you are under 14 years of age.

Information We Collect and Save

To facilitate the purposes associated with this website, Parkland Cares gathers and maintains information about you that it may use to build support for common sense solutions that help prevent similar tragedies from happening again. You grant us the right to publish your name, for example, in the form of a list of supporters, but your contact information such as your email will not be shared publicly or with any other organization. At times in the process of using our website you may also have access to or be directed to the websites of other organizations including nonprofit partners, fundraising groups, or those created by the families of the victims. You are advised that these organizations and groups may have different privacy policies and practices, as well as terms and conditions that vary from ours. Information provided on other website by these organizations and groups is updated entirely by these entities and Parkland Cares does not verify this information for accuracy.

Our Website and mobile application use forms in which you give us contact information (including your name, address, telephone number, and email address) so you can place orders, request information and support, and make product suggestions. For certain services, we may also request a credit card number, government identification number, or other financial information. We will then create an account number for you. We receive and store any information you enter on our Website, mobile application, or give us in any other way, including through email, telephone, or other communications with our customer service department. If you contact us for support, we will keep an internal record of what support was given. We use your information to contact you regarding functionality changes to our products, our Website and mobile application, new Parkland Cares services, and special offers we think you’ll find valuable. This is not linked to any personally identifiable information, except as necessary to prevent fraud or abuse on our system. Our Website and mobile application use cookies to keep track of your shopping cart and receipts. We use cookies to identify you so you don’t need to log in each time you visit our Website or mobile application. The cookies are linked to your customer number, which is associated with the information in your account. Within our mobile application we use tracking technologies such as: CI codes (click tracking), ISC (source tracking), and ITC (item tracking codes, attached to purchases at an item level, used to determine where within the application a product was added). Our mobile application automatically collects the device’s operating system, phone model, app version, and device ID, and the user’s customer number. We report this data back to our Parkland Cares web services. These results are not shared with any third parties and are used solely for deciding when to retire SDKs/OS versions and to identify characteristics of major users so that we may optimize our application for those user types. We do not ask you for, access, or track any location-based information from your mobile device at any time while downloading our mobile application or services. We do not tie any personally identifiable information you submit within our mobile application to any of the tracking technologies that we use.

By registering on this site and using its features, you agree to abide by the terms and conditions and privacy policies of this site, as expressed here, as well as abide by changes to these policies which may occur from time to time with or without notice. You also understand that the information, methods, images, technical elements, and functionality of this site are the protected property of Parkland Cares and are proprietary and in some instances protected by federal copyright and trademark laws. You agree that you will not copy, replicate, duplicate, share, or make use for your own purposes any of the information or elements on this website without the express written consent of Parkland Cares. You are granted the limited right to use this site and its protected information and resources as a registered user in exchange for your agreement to comply fully with the Terms of this site. At any time, Parkland Cares may revoke your rights to use this site at any time and even to permanently ban you from accessing it and its services without notice.

Limited Rights Use

The logos that appear on the site which are the sole property of Parkland Cares and may be subject to federal copyright and trademark laws.

You are permitted, under a limited license granted by Parkland Cares to copy and download these logos for the sole and express use of supporting and promoting in a non-commercial way your participation in the Parkland Cares, or to encourage others to do so. By using these logos in any way, you agree to abide to certain terms and conditions of use, specifically that, (1) you will not modify these elements in any way except in terms of sizing, for instance, you cannot change colors or typeface, nor can you add any new information, text or images to these logos, (2) you will not place any other logos too close to our logos, such that this might be interpreted that our logos are owned or part of any other organization or program, and (3) you will not use these logos in any way to sell items. In other words, you may not use our information or logos for any commercial gain or in concert with product or service offers without the express written permission of Parkland Cares. User Generated Content

Our website may in the future allow its users to share and comment upon content and communicates in many ways utilizing audio, video, instant messaging, email and text message.

To have the full Parkland Cares experience and to access some features on the Website, you may have to create a User account. In creating a User account, we ask that you must provide complete and accurate information about yourself to bolster your credibility as a contributor to the Website. Notwithstanding the foregoing, you may not misidentify as someone else (e.g., assume the identity of a neighbor, celebrity or stranger), provide an email address other than your own, or create multiple User accounts and profiles.

If you have created a User account with Parkland Cares, you are responsible for the security of your account and password, if one is assigned to you by us. We reserve the right to close your account and remove any content submitted by you at any time for any or no reason.

We grant you a limited license and permission to access and make personal use of our website but not to download or copy any portion of its content for any commercial purpose or to modify any portion of it, except as noted under our Limited Rights of Use, or with our written or e-mailed consent. License to Parkland Cares Users

You agree that, by submitting any User-Generated Content to Parkland Cares, you are granting to Parkland Cares a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, and display that User-Generated Content in connection with the this Website and Parkland Cares’ (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of this Website (and derivative works thereof) in any media formats and through any media channels.

You also hereby grant each User of this website a non-exclusive license to access your User-Generated Content through the Website, and to use, reproduce, distribute and display such User-Generated Content as permitted through the functionality of the Website and under these Terms.

The above licenses granted by you terminate within a commercially reasonable time after you remove or delete your User-Generated Content videos from this website. Parkland Cares’ Use of User-Generated Content

Parkland Cares may or may not use your User-Generated Content in its sole discretion. For example, we may choose not to publish your User-Generated Content if we believe it violates the Terms. In addition, please note that we have no obligation to retain or provide you with copies of your User-Generated Content, nor do we guarantee any confidentiality with respect to your User-Generated Content.

Parkland Cares and its partners, licensees and funders may display advertisements and other information adjacent to or included with your User-Generated Content on the Website and other media. You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising are subject to change without specific notice to you.

Targeted Advertisements

Parkland Cares may display targeted offers to our customers based on the products currently owned by the customer. These offers will display as varying product banners. There is no personal or geolocation information collected within these product banners to build a profile about your activities or that is shared with third party advertising companies. Tell-A-Friend If a user elects to use our referral service to inform a friend about our Website or mobile application, we ask the user for the friend’s name and email address.

Parkland Cares will automatically send the friend a one-time email inviting them to visit our Website. Parkland Cares stores this information for the sole purpose of sending this one-time email. The friend may contact Parkland Cares at [email protected] to request the removal of this information from our database.

Third-Party Service Providers and Partners

We may at times provide information about you to third parties to provide numerous services on our behalf, such as processing credit card payments, serving advertisements, conducting contests or surveys, performing analyses of our products or customer demographics, shipping of goods or services, and customer relationship management. We will only share information about you that is necessary for the third party to provide the requested service.

These companies are prohibited from retaining, sharing, storing or using your personally identifiable information for any secondary purposes. If we use third party advertising companies to serve ads on our behalf, these companies may employ cookies and action tags (also known as single pixel gift or web beacons) to measure advertising effectiveness. Any information that these third parties collect via cookies and action tags is completely anonymous.

Donations Made Through This Website

This website is used by Parkland Cares to enable individuals to make online donations to support our work. Parkland Cares is in the process of becoming a 501(C)(3), nonprofit, tax exempt entity. In the interim, Parkland Cares is operating as a fund of the nonprofit Broward Education Foundation, a section 501(C)(3) organization. Contributions to the Foundation are tax deductible.

Termination

Parkland Cares reserves the right, in its sole discretion, to restrict, suspend, or terminate your access to all or any part of the Website at any time, for any or no reason, with or without prior notice, and without liability. Parkland Cares expressly reserves the right to remove your User account and/or restrict, suspend, or terminate your account and your access to any part of the Website if it determines, in its sole discretion, for example, that you breached the Terms or are suspected of involvement in illegal activity.

You may request that your information on our website be removed at any time, for any reason, by sending an email to [email protected], Subject: REMOVE MY INFORMATION. In the event we choose to remove all or a portion of the information you have provided to us using this website, this Terms shall remain in effect.

What Happens to my Personal Information if I Terminate my Parkland Cares Account?

When your Parkland Cares account is cancelled (either voluntarily or involuntarily) all your personally identifiable information is placed in “deactivated” status on our relevant Parkland Cares databases.

However, deactivation of your account does not mean your personally identifiable information has been deleted from our database entirely. We will retain and use your personally identifiable information as necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

Choice of Law and Forum

You agree that, unless expressly waived by us, the exclusive jurisdiction for any claim or action arising out of or relating to these Terms or your use of this website shall be in the state or federal courts located in Broward County in the State of Florida, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
